Terms & Conditions
By making use of the whois privacy services offered and provided by proxy-privacy.com/IDPS GmbH,
the customer (registrant) agrees and is bound to the following additional terms and conditions.
- The whois privacy services ("privacy basic", "privacy pro") are offered as an optional and supplemental service
for individual registrations of domain names.
The whois privacy services are available for new and existing domain names of selected top level domains, registered with Joker.com (registrar).
The registrant of a domain name eligible for whois privacy services may activate this service either as an option provided with the
order (registration) of a new domain, as an option during the renewal of a domain, as an option when transferring a domain to IDPS GmbH/Joker.com
or as a separate option for existing domains, provided the domain name is not used commercially.
The registrant shall be able to deactivate whois privacy service at any time at his own discretion, which then will replace the public whois data with
his own personal data.
- The registrant of a domain name using whois privacy service will remain the legally responsible owner of the domain name. He shall retain
full control over all aspects of the domain name.
The registrant of a domain name using whois privacy is obliged to ensure and be responsible for ensuring,
to the best of his knowledge and belief, that the subsequent direct or indirect use of the domain resulting from registration does not
interfere with rights of third parties and he gives an assurance that no rights of this kind are infringed.
The registrant of a domain name using whois privacy agrees to release, defend, indemnify and hold harmless the whois privacy service provider IDPS GmbH,
Joker.com as registrar, and its directors, officers and employees from and against any and
all claims, demands, liabilities, losses, damages or costs, including attorney's fees, arising out of or related in
any way to the domain registration itself, the privacy services provided and/or the registrant's use of his domain name registration.

The registrant is obliged to provide truthfully and maintain true up-to-date domain name data as provided for registrations in the general
registration agreement (Terms and Conditions) of IDPS GmbH/Joker.com, including name, postal address, email address, phone number of owner,
admin, billing and tech contacts.
The registrant agrees that his personal domain registration data will be maintained by Joker.com (registrar), and escrowed to
3rd party escrow provider in case the regulation for a domain name requires this escrow (ICANN regulated gTLDs).
The whois privacy provider IDPS GmbH, as well as registrar Joker.com, shall keep this data confidential, pursuant to section 5) of this document.
In case of non-valid or fake registration data, IDPS GmbH is entitled to disclose the registrant's data/identity,
to cancel the services provided for the domain name, or to deactivate the domain name.

By making use of the whois privacy services, the registrant agrees and confirms that the registrar shall act as 'Designated Agent' on behalf of the registrant, for the purpose of
making the privacy service related Whois changes (only applicable to ICANN policed top level domains).
- Domain names using whois privacy services will display the following data in public whois output in place of the registrant's information:
privacy basic:
- registrant's name and/or organization name
- postal address of the service provider
- phone number of the service provider
- a generated anonymous individual email address redirecting all electronic communications to the email provided by the registrant
- an optional status string of the service provider
privacy pro:
- organization name of the service provider
- postal address of the service provider
- phone number of the service provider
- a generated anonymous individual email address redirecting all electronic communications to the email provided by the registrant
- an optional status string of the service provider
- The registrant agrees that the whois privacy service provider may at its sole discretion and at any time terminate the whois privacy service
without liability to the registrant, and disclose registrant's identity and whois data for any reason. Reasons for this include but are not
limited to:
- non-payment for the whois privacy service
- the deletion of a domain name
- breach of any provision of this agreement or the applicable registration agreement with Joker.com as registrar
- request by law of applicable jurisdiction
- request by a registry, a court order or a law enforcement agency
- reception of a legal complaint regarding the use or registration of a domain name
- reception of a formal UDRP service provider request
- resolution of third party claims
- to avoid financial loss or legal liability of the whois service provider, the registrar, its shareholders, officers, employees and directors
- third party complaint of illegal or morally objectionable use of the domain name, like qualified reports of contributing to SPAM or malware
- qualified evidence for allegation of use of the whois privacy service to be involved with illegal, illicit, objectionable or harmful activities
- qualified evidence for allegation that the registration infringes legal rights of a third party, or third-party trademarks
- good faith that disclosure is necessary to further inquire an alleged breach of a law
- use of the domain name for commercial purposes
The termination of the whois privacy service will result in instant disclosure of the registrant's whois information. If technically and
legally possible, the whois privacy service provider strives to notify the registrant 24 hours before whois privacy service is terminated.
- The whois privacy service provider shall not be held liable for failures or interruptions of the whois privacy service due to higher force or
events not under reasonable control or influence of the whois privacy service provider.
The whois privacy service provider is entitled to limit or postpone the start of a domain names privacy service, in case the integrity and stability
of the network and the whois privacy service providers operations, or the stability of registry-related operations requires it.
The liability of whois privacy service provider will be limited to the amount paid by the registrant for the whois privacy service.
- The fees for the whois privacy services are charged through the registrar Joker.com.
Fees are published on the registrar's website, and can be changed without notice at any time. Whois privacy services may be acquired for existing domain names, and together
with the registration, the renewal or the transfer of a domain name. When acquired with a transfer, whois privacy service will be charged for one (1) year,
and the term for the chosen privacy services will be one (1) year, plus the remaining term until the domain's day of creation.
When acquired with renewal, transfer or as a separate option, the term will be synchronized with the term of the associated domain name.
The Term of whois privacy services will be rounded up or down when acquired for an already existing domain name, according to the term of this
domain name. In case the domain name is deleted or transferred out, no refunds or partial refunds are possible.
- Domain names using whois privacy services and which are configured for auto-renewal will be auto-renewed including the whois privacy service. In case
a domain name due to auto-renewal is using a whois privacy service, but this service is deactivated by registrant or registrar at the time of renewal,
the domain name will be renewed without whois privacy services.
- Changing the whois privacy service for a domain name from privacy basic to privacy pro or vice versa is possible, but
the remaining term of the to-be-changed service will be lost. There will be no refund in this case.
- The whois privacy service provider is entitled to refuse any transfer request or request for an authorization code for a domain
name by the registrant as long as the whois privacy service is enabled.
- The whois privacy service provider may limit the whois privacy service to top level domains of his choice.
- Any email sent to the provided whois privacy email address will be instantly forwarded to the registrant's email address.
In order to protect the registrant from SPAM or malware, all emails will be automatically processed by commonly used filtering
systems before forwarding.
The whois privacy service provider is not obliged to contact the registrant by any other method than email.
- Non-electronic communications directed to the registrant via postal address of the whois privacy service provider will not be forwarded to
the registrant.
The registrant agrees that the whois privacy service provider may review, reject or discard all non-electronic communications directed
to the registrant.
The registrant agrees that he will be liable for any and all claims which may arise by his failure to receive communications directed to
his domain name.
- Agreed as court of jurisdiction for all disputes arising from the use of the services of IDPS GmbH is Duesseldorf, Germany. Place of performance is Duesseldorf, Germany.

Collateral agreements, amendments and supplements to the Terms and the performance of the contract must be in writing and the
written form can only be dispensed with by written agreement.
The written form is agreed to have been complied with by send-protected e-mails.
